We process personal data that we receive from you as part of the application process. This includes master data (such as name, address, telephone numbers and e-mail address, date of birth, marital status, etc.), data on school and vocational education, data on extra-occupational interests, data on the content of former/current employment relationships, application photo and other data that you voluntarily provide to us during the application process.

 

For what purposes do we process your data and on what legal basis?

 

We process personal data that we receive from you as part of the application process. This includes master data (such as name, address, telephone numbers and e-mail address, date of birth, marital status, etc.), data on school and vocational education, data on extra-occupational interests, data on the content of former/current employment relationships, application photo and other data that you voluntarily provide to us during the application process.

For what purposes do we process your data and on what legal basis?

 

We process your personal data in accordance with the provisions of the European General Data Protection Regulation (GDPR) and the new German Federal Data Protection Act (BDSG-neu) for various purposes.

In principle, Art. 6 para. 1 lit. b GDPR is the basis for the processing of data for the decision on the establishment, for the establishment and for the execution of employment relationships. In addition, the relevant legal basis for safeguarding legitimate interests is Art. 6 para. 1 lit. f GDPR or, on the basis of consent, Art. 6 para. 1 lit. a GDPR. The legal basis for the reimbursement of expenses is Art. 6 para. 1 lit. c, f GDPR.

 

A legitimate interest is given, for example, after the conclusion of an employment contract. The data is filed and stored in the personnel file.

 

Who receives my data?

Within CREMER (Peter Cremer Holding GmbH & Co.KG, Peter Cremer GmbH, CREMER OLEO GmbH & Co. KG, CREMER OLEO Management GmbH, CREMER OLEOServ GmbH, ProLine Shipping GmbH, H.F. Navigator GmbH, Campus GmbH, Plantera GmbH), only those departments entrusted with the preparation and realisation of the application process will receive your data. These are the Human Resources employees and the departments in which the position is to be filled, the potential managers.

How long will my data be stored?

 
If necessary, we process and store your personal data for the duration of the application process.If an employment relationship is established following the application process, the data will initially continue to be stored and transferred to the personnel file. Otherwise, the application process ends with the receipt of a rejection from the applicant.The data will be deleted no later than 6 months after receipt of the rejection. This does not apply if the processing and storage of your personal data is necessary in the specific case for the assertion, exercise or defence of legal claims (duration of a legal dispute).


In individual cases, individual data may be stored for longer (e.g. travel expense reports).The duration of storage then depends on the statutory retention obligations, e.g. from the German Fiscal Code (6 years) or the German Commercial Code (10 years).Finally, the storage period is also determined by the statutory limitation periods, which can be up to thirty years, for example in accordance with Sections 195 et seq. of the German Civil Code (BGB), whereby the regular limitation period is three years.

 
If you are not hired but your application is still of interest to us, we will ask you whether we may keep your application on file for future vacancies.

Is data transferred to a third country or to an international organisation?

Data is not transferred to third countries.

 
What data protection rights do I have?

 
Every data subject has the right of access under Art. 15 GDPR, the right to rectification under Art. 16 GDPR, the right to erasure under Art. 17 GDPR, the right to restriction of processing under Art. 18 GDPR and the right to data portability under Art. 20 GDPR.To exercise the aforementioned rights, you can contact the controller (point 1.).

 
Insofar as your personal data is processed to safeguard our legitimate interests in accordance with Art. 6 para. 1 lit. f GDPR, you can object to this processing in accordance with the legal requirements in Art. 21 GDPR.The objection can be made informally at personal@cremer.de .


If you have given us your consent to data collection, you can revoke this at any time without any formal requirements, e.g. at personal@cremer.de .

In addition, you have the right to lodge a complaint with a data protection supervisory authority (Art. 77 GDPR) if you believe that your personal data is being processed unlawfully.

Am I obliged to provide data?

There is no legal or contractual obligation to provide data. As part of your application, you should only provide the personal data that is necessary for the acceptance and realisation of the application. Without this data, however, we will have to reject your inclusion in the application process, as we will then not be able to make an objective decision.

To what extent is there automated decision-making in individual cases?

Decision-making in the context of the application process is not based on automated processing in accordance with Article 22 GDPR.

​Applicant data will be added to the CREMER candidate pool and stored for more than six months. CREMER may contact people in the pool if an advert matches the qualifications. 
 
Consent to the storage of contact and application data and to CREMER making contact on its own initiative can be revoked at any time. The cancellation can be made in writing or by telephone.
 
Data will only be passed on to third parties, including companies within the group of companies, with the prior information and consent of the applicant.
